The only lawful cannabis dispensing in Texas is through the Texas Compassionate Use Program (CUP), authorized under Texas Occupations Code Chapter 169 and Texas Health and Safety Code Chapter 487, which allows licensed dispensing organizations to dispense low-THC cannabis (generally 1 percent or less delta-9 THC) by prescription to patients with qualifying conditions such as epilepsy, autism, cancer, and PTSD. The Texas Department of Public Safety licenses the limited number of CUP dispensing organizations, and as of this writing none are located in Mansfield. CBD and hemp-derived consumable products containing less than 0.3 percent delta-9 THC may be sold under Texas Agriculture Code Chapter 122 and Health and Safety Code Chapter 443 at ordinary retail, and such retailers are subject to standard Mansfield commercial zoning rules.
