Recreational and medical cannabis dispensaries are illegal in Haltom City under Texas Health and Safety Code Chapter 481. Only state Compassionate Use providers may dispense low-THC cannabis, and none operate locally.
Cannabis dispensaries in the sense of a recreational or adult-use storefront do not exist anywhere in Texas. Marijuana is an illegal controlled substance under Texas Health and Safety Code Chapter 481 and the federal Controlled Substances Act. Haltom City cannot permit or zone for a recreational cannabis retailer because doing so would violate state law. The only legal cannabis-adjacent retail activity in Texas is the Texas Compassionate Use Program (TCUP) under Occupations Code Chapter 169 and Health and Safety Code Chapter 487. TCUP allows qualified patients with conditions such as epilepsy, cancer, PTSD, multiple sclerosis, and terminal illness to receive low-THC cannabis (up to 1 percent delta-9 THC) prescribed by a physician registered with the state program. Low-THC cannabis is produced and dispensed only by Texas Department of Public Safety-licensed dispensing organizations. As of early 2026, only a small number of dispensing organizations are licensed statewide (Compassionate Cultivation, Surterra Texas doing business as Goodblend, and Fluent among the known licensees), and they operate from limited locations primarily delivering statewide rather than operating storefronts in each city. None are publicly known to operate retail storefronts in Haltom City. Hemp-derived products containing delta-8, delta-9 (up to 0.3 percent), delta-10, THCA, and CBD have been sold in unregulated retail stores across Texas since 2019, but Texas Senate Bill 3 (2025) tightened rules on consumable hemp products and many cities including some in Tarrant County have considered local moratoria on hemp shops. Haltom City has adopted zoning classifications for smoke shops and vapor product retailers through its land development regulations. Any future changes in state or federal cannabis law would require amendment of the Haltom City zoning map and ordinance. Businesses interested in the Compassionate Use Program licensing should work with the Texas DPS Regulatory Services Division and coordinate any local zoning review with Haltom City Planning at (817) 222-7700.
