Cannabis cultivation is illegal in Texas. Texas has one of the most restrictive cannabis laws in the nation. The Texas Compassionate Use Program (TCUP) allows very limited medical use of low-THC cannabis but does not permit home cultivation. Arlington enforces state law.
Texas Health and Safety Code Chapter 481 classifies marijuana as a Schedule I controlled substance. Possession of any amount is a criminal offense. The Compassionate Use Act (2015, expanded 2019 and 2021) allows limited low-THC cannabis (no more than 1% THC) for qualifying medical conditions, but products must be purchased from licensed dispensaries. Home cultivation of any cannabis plants is a serious criminal offense in Texas. No local ordinances can override state cannabis prohibition.
Cultivation of cannabis is a felony in Texas. Penalties vary by weight: under 2 oz is a state jail felony (180 days to 2 years), 2 oz to 4 lbs is a third-degree felony (2-10 years), and higher quantities carry increasingly severe penalties. Asset forfeiture may apply.
