Home cultivation of cannabis is ILLEGAL in Huntsville and throughout Alabama. Alabama Medical Cannabis Act (SB 46, 2021) permits licensed medical production only. Recreational cannabis is a felony under Ala. Code 13A-12-213.
Alabama prohibits all home cultivation of cannabis. The Alabama Medical Cannabis Act (SB 46, 2021, codified Ala. Code 20-2A-1 et seq.) established a medical cannabis program but does NOT permit patients to grow their own plants. Only licensed cultivators authorized by the Alabama Medical Cannabis Commission may grow cannabis. Medical products are limited to non-smokable forms (tablets, capsules, oils, gels, patches) for qualifying conditions. Recreational cannabis remains fully illegal. Unlawful manufacture of a controlled substance (cultivation) is a Class B felony under Ala. Code 13A-12-217 with 2 to 20 years imprisonment. Huntsville Police and Madison County Sheriff actively enforce cannabis laws.
Cultivation: Class B felony, 2 to 20 years imprisonment and up to 30,000 dollar fine. Possession of marijuana first degree: Class D felony, up to 5 years. Personal use second degree: Class A misdemeanor, up to 1 year.
