ORS 475C.337 (formerly ORS 475B.245) authorizes any household in Oregon to possess up to four cannabis plants for noncommercial personal use, regardless of how many adults reside there. The plants must be grown out of public view from a public place, and harvested usable marijuana over eight ounces must be kept in a locked space at the residence. Medical patients and caregivers under ORS 475C.770-475C.919 may grow additional plants subject to OHA registration. Local governments may regulate odor, electrical safety, and structures but cannot ban personal four-plant cultivation, which is preempted as a permitted personal use under state law.
Exceeding four plants per household is a Class B violation; possessing more than 16 ounces of usable marijuana at home is a Class B misdemeanor under ORS 475C.341.
