SRC § 31.030 requires any person or entity operating a marijuana business in Salem—including retail dispensaries, producers, processors, and wholesalers—to obtain and maintain a valid city registration in addition to the state OLCC license. Dispensaries may not locate within 1,000 feet of a public or private elementary or secondary school, consistent with ORS 475C.840. Allowed zoning districts include commercial and mixed-use zones under the Unified Development Code (Title X); dispensaries are not permitted in areas zoned exclusively for residential use. SRC Chapter 32 imposes a local marijuana sales tax. The Community Development Department and OLCC jointly oversee compliance.
Operating without a city registration is a violation of SRC § 31.030, subject to civil penalty; licenses may be revoked and the business ordered closed. Each day of non-compliance is a separate violation.
