Personal cultivation in Boulder is governed by Colorado Amendment 64 (2012) as implemented in CRS Β§18-18-406. Each adult 21 or older may possess up to six marijuana plants, of which no more than three may be flowering at one time. A single residence may host at most 12 plants total even if more than two adults live there β a cap added by HB17-1220 to address grey-market diversion. Plants must be grown in a fully enclosed locked space and kept out of public view. Boulder does not require a city permit for compliant home cultivation, but landlords may prohibit it in the lease. Medical patients with extended-plant-count waivers must register with the Colorado Marijuana Enforcement Division.
Exceeding the six-plant per-adult or twelve-plant per-residence cap, growing in public view, or cultivating without a locked enclosure can support criminal charges under CRS Β§18-18-406 and city nuisance enforcement.
