Boulder adopts the International Fire Code under Boulder Revised Code Title 10 Chapter 8 (Fire Code). IFC Section 308.1.4 prohibits charcoal burners, gas grills, and other open-flame cooking devices on combustible balconies or within 10 feet of combustible construction in multifamily buildings β a heavily enforced rule given Boulder's dense student housing near CU Boulder. Exceptions exist for sprinklered balconies, one- and two-family dwellings, and 1-pound (2.5 lb water capacity) camping propane cylinders. Inside the expanded WUI (effective Aug. 1, 2025) additional restrictions apply.
Boulder Revised Code Title 10 Chapter 8 (BRC 10-8-2) adopts the International Fire Code by reference, with local amendments. IFC 308.1.4 controls open-flame cooking on or near combustible construction in apartments, condos, and similar Group R-1 and R-2 occupancies: no charcoal burner, gas grill, or other open-flame device may be operated on combustible balconies or within 10 feet of combustible construction. Three exceptions apply: (1) one- and two-family dwellings (R-3), so single-family backyard grilling is generally permitted; (2) buildings or balconies protected by an automatic sprinkler system covering the balcony area; and (3) LP-gas devices with a container of no more than 2.5 lbs water capacity (the 1-pound camping cylinder). Boulder Fire-Rescue actively enforces this rule against student rentals in the University Hill, Goss-Grove, and Martin Acres neighborhoods. Penalties are unusually steep: BRC 5-2-4 allows fines up to $1,000 per day of violation plus up to 90 days in jail per offense β Boulder Fire-Rescue publicly cites the example that a 30-day continuing violation can theoretically reach $30,000. Storage of LP-gas cylinders larger than 1 lb on multifamily balconies is also barred. Inside the expanded Wildland-Urban Interface (16,000 homes as of Aug. 1, 2025), additional ignition-resistant construction and clearance standards apply, but the 308.1.4 rules are the day-to-day enforcement vehicle. Boulder routinely issues Stage 1 and Stage 2 fire restrictions during summer drought; Stage 2 can ban charcoal use even in single-family backyards.
IFC violations under BRC Title 10 Chapter 8 are prosecuted in Boulder Municipal Court with fines up to $1,000 per day and/or 90 days in jail under BRC 5-2-4. Property managers and tenants can be cited jointly. Boulder Fire-Rescue routinely cites grill use on student-rental balconies near CU Boulder and a grill-caused fire that spreads exposes the operator to civil liability and lease termination on top of municipal penalty. Stage 2 burn-restriction violations carry additional fines.
