Section 222 of the New York Cannabis Law authorizes home cultivation by adults 21 and older once OCM finalizes home grow rules (effective for adult-use growers). Each adult may grow up to three mature and three immature plants, with a household maximum of six mature and six immature plants regardless of how many adults reside there. Plants must be in a secured location not visible from a public place and inaccessible to minors. Westchester municipalities cannot prohibit home cultivation outright but may regulate odor and visibility through nuisance and zoning rules. Medical cannabis patients have separate limits set by OCM regulations.
