Under State Question 788 (2018), codified at 63 O.S. Β§420 et seq., a licensed Oklahoma medical marijuana patient may grow up to six mature plants and six seedlings for personal medical use. Plants must be kept out of public view and secured to prevent access by minors. Oklahoma City has not adopted additional caps below the state limit, but home grows must still comply with OKC zoning, building, and electrical codes for any improvements such as added grow rooms or supplemental ventilation. Recreational personal cultivation is not permitted because State Question 820 failed in March 2023. Federal preemption still bars cultivation in federally subsidized housing.
Growing without a valid OMMA patient license, exceeding plant counts, growing in public view, or failing to secure plants from minors can lead to confiscation, license action, or criminal charges.
