Initiative 71 amended DC Code 48-904.01 to legalize possession of up to two ounces and home cultivation of six plants per person, capped at three mature plants. Households with multiple adults are limited to twelve plants total regardless of occupancy. Plants must be grown inside the cultivator's primary residence and may not be visible from public space. The Harris Amendment, a Congressional appropriations rider attached annually since 2015, blocks DC from spending funds to legalize commercial taxed retail sales, leaving cultivation as the main legal source.
Cultivating beyond six plants, growing outside your primary residence, or selling homegrown cannabis triggers DC Code 48-904.01 penalties up to six months jail and $1,000 fines.
