Lincoln has not enacted an ordinance specifically banning drones in McBean Park, Foskett Regional Park, or other city parks. The Parks & Recreation Department may restrict UAS launch/landing on a facility-by-facility basis through posted rules. Federal airspace rules (49 U.S.C. §44809 / 14 CFR Part 107) still apply.
Searches of the Lincoln Municipal Code do not reveal a chapter prohibiting UAS launch, landing, or flight in city parks. By contrast, California State Parks (Cal. Code Regs. tit. 14 §4322) prohibit motorized model aircraft in many units, and the National Park Service bans drones in all NPS units (36 CFR §1.5). Lincoln Parks & Recreation manages McBean Park, Foskett Regional Park, Auburn Ravine Trail, and other city facilities — the department has authority under LMC Title 12 (Streets, Sidewalks, and Public Places) to post and enforce facility-specific rules. Pickleball court rules at McBean Park, for example, already prohibit non-pickleball activities. Pilots launching from any city park should: (1) confirm the park does not have posted UAS prohibition (call 916-434-3220), (2) yield to ball games, scheduled events, and pavilion rentals, (3) avoid flying over crowds (Part 107.39), (4) avoid filming park visitors without consent (Civil Code §1708.8), and (5) never operate over the McBean Stadium fields during a baseball/softball game. Note: Lincoln Crossing and Twelve Bridges schools are within Western Placer Unified — Cal. Penal Code §626.8 makes it a misdemeanor to disrupt a school in session, which can apply to drone overflight that interferes with class. Park flights near KLHM (Lincoln Regional) still require notification of the airport operator within 5 statute miles per FAA recreational rules.
Violation of posted park rules is enforceable as a misdemeanor or infraction under LMC Title 1 general penalty provisions (LMC §1.16.010 — typically up to $1,000 fine and/or 6 months for misdemeanor; up to $250 / $500 / $1,000 escalating infraction fines). State penalties: Penal Code §402 (first-responder interference) — misdemeanor, up to 6 months county jail and $1,000; Penal Code §626.8 (school disruption) — misdemeanor; Civil Code §1708.8 — treble damages plus $5,000 statutory minimum. Park & Recreation rangers may eject violators and revoke any rental permit.
