Lincoln's authority over sidewalk vendors is constrained by California's Safe Sidewalk Vending Act (SB 946, codified at Gov. Code §§51036–51039). California Government Code §§51036–51039 (SB 946, 2018) preempts most local sidewalk-vending bans. A 'sidewalk vendor' is anyone selling food or merchandise from a pushcart, pedal-driven cart, wagon, showcase, rack, or other non-motorized conveyance on a public sidewalk or pedestrian path. Lincoln may not (1) prohibit sidewalk vending in non-residential areas, (2) cap the total number of vendors citywide except for objective health/safety reasons, or (3) require operation in a specific part of the right-of-way unless objectively justified. Lincoln may set reasonable hours, require a business license (LMC Title 5), require sanitation, and prohibit vending within a Certified Farmers' Market, a swap meet, or a temporarily permitted special event. Food vendors must hold a Placer County Environmental Health Mobile Food Facility (MFF) permit under the California Retail Food Code (Cal. Health & Safety Code §113700 et seq., amended by SB 972 in 2022 to make compact mobile units like 'cart' types compliant). SB 972 also bars the use of past unpermitted food sales as grounds to deny a future permit. Violations may be punished only by administrative fines on a sliding ability-to-pay scale; criminal citation is prohibited under §51039(a)(4).
First violation (no city permit/business license): up to $100 administrative fine. Second violation within 1 year: up to $200. Third and subsequent violations: up to $500 (Gov. Code §51039(b)(1)). Operating without a Placer County Environmental Health food permit can additionally trigger Health & Safety Code §114409 penalties. Vendors may petition for an ability-to-pay reduction to 20% of the listed amount. Lincoln may not impound carts as a sanction.
