Lincoln Municipal Code Chapter 5.36 (Peddlers) requires anyone going door-to-door to sell goods or services within the city to first obtain a Peddler Permit issued by the Lincoln Police Department (770 7th Street, 916-645-4040). The application includes a criminal-background check. A person is not eligible if they have been convicted of a felony, or a crime of moral turpitude, within the previous 10 years. Permits are issued for a term not exceeding one year and expire on the date printed on the face of the permit. Permitted peddlers may operate any day of the week, but only between the hours of 8:00 a.m. and 8:00 p.m. Peddlers must display the permit and show it to any police officer or resident on request. The ordinance does not displace federal protections for non-commercial speech (religious canvassing, political solicitation) — Watchtower Bible v. Stratton (2002) controls — but commercial peddling is subject to the registration requirement. The Lincoln peddler ordinance is separate from California's Safe Sidewalk Vending Act (SB 946 / Gov. Code §51038 et seq.), which decriminalizes non-motorized sidewalk vendors selling food or merchandise on public sidewalks and pedestrian paths.
Operating as a peddler without a permit, or after a permit has been revoked, is a misdemeanor under LMC §1.16.010 — up to 6 months in county jail and/or a $1,000 fine. Operating outside the 8 a.m.–8 p.m. window or refusing to show the permit may result in citation, immediate cessation, and permit revocation. Residents may post 'No Solicitors' signs at the property line; entering past a posted sign can be cited under Cal. Penal Code §602(o) (trespass after notice).
