Recreational drones regulated primarily by FAA under 14 CFR Part 107 and Exception for Limited Recreational Operations (49 U.S.C. 44809). Pennsylvania Act 78 of 2018 (18 Pa.C.S. 3505) created crime of unlawful use of unmanned aircraft. Allegheny County parks prohibit drone launch or landing without permit.
PA 18 Pa.C.S. 3505 criminalizes using a drone to conduct surveillance, deliver contraband to prisons, or interfere with first responders. Violation is third-degree misdemeanor. Act 78 preempts most local drone regulation but allows municipal regulation of takeoff and landing from municipal property. Allegheny County Parks prohibit drone operations from county park land without written permission. FAA registration required for drones over 0.55 lb; Remote ID mandatory since September 2023. Pittsburgh International Airport Class C airspace covers much of the western county, requiring LAANC authorization.
PA 18 Pa.C.S. 3505 violations: up to one year jail and 2500 dollars fine (third-degree misdemeanor). FAA civil penalties up to 27500 dollars per violation. County park violations: 300 dollars plus confiscation possible.
