The Building Emissions Reduction and Disclosure Ordinance covers buildings 20,000+ square feet or 15+ residential units. Owners must benchmark energy use through ENERGY STAR Portfolio Manager, then progressively reduce CO2 emissions on five-year compliance periods beginning 2025 (large) and 2030 (medium). The Air Pollution Control Commission enforces emissions limits per use-type. Owners may use Alternative Compliance Payments routed to an Equitable Emissions Investment Fund supporting affordable housing decarbonization. Boston targets carbon neutrality citywide by 2050 under its Climate Action Plan.
Failure to report or exceeding emissions caps incurs penalties up to $1,000 per day plus per-ton CO2 alternative compliance payments through the BERDO Review Board.
