Under the Clean Streams Law and 25 Pa. Code Chapter 102, anyone conducting earth disturbance in Pennsylvania must implement written erosion and sediment control plans, with permits required for projects disturbing one acre or more.
Chapter 102, authorized by 35 P.S. Sections 691.1-691.1001, requires best management practices for any earth disturbance regardless of size. Projects disturbing 5,000 square feet or more must have a written E&S plan on site. Disturbances of one acre or more, or any size in special protection waters, require an NPDES Permit for Stormwater Discharges Associated with Construction Activities, administered by DEP and county conservation districts. Plans must address runoff control, sediment basins, and post-construction stormwater management.
Civil penalties up to $10,000 per day, plus daily continuing-violation fines and required restoration, can be assessed under the Clean Streams Law.
