ORC 1511.02 authorizes the Ohio Soil and Water Conservation Commission to adopt the rulebook governing urban sediment pollution abatement, while ORC 1515 establishes county soil and water conservation districts that enforce sediment control on construction sites under one acre that are not under the EPA NPDES Construction General Permit. Operators must install best management practices including silt fences, sediment basins, inlet protection, and stabilized construction entrances, and must stabilize disturbed soils within seven days after final grading. Agricultural operations must comply with operation and management plans for pollution abatement under ORC 939.
Failure to install required erosion controls or comply with a sediment abatement order can result in stop-work orders from the soil and water conservation district, civil penalties under ORC 1511.99, and Ohio EPA enforcement under Chapter 6111 for waterway impairment.
