Disturbances of one acre or more, or any size in special protection waters, require an NPDES Permit for Stormwater Discharges Associated with Construction Activities, administered by DEP and county conservation districts. Plans must address runoff control, sediment basins, and post-construction stormwater management.
Civil penalties up to $10,000 per day, plus daily continuing-violation fines and required restoration, can be assessed under the Clean Streams Law.
