Evanston's Lake Michigan shoreline includes public beaches, parks, and bluffs as well as some privately owned lakefront properties. The city's Public Works and Parks departments manage public shoreline infrastructure including revetments, beach groins, and seawalls. Private property owners along the lakefront must obtain permits from the Illinois Department of Natural Resources (IDNR) and the U.S. Army Corps of Engineers before constructing, modifying, or repairing shoreline protection structures. IDNR issues permits under the Rivers, Lakes and Streams Act (615 ILCS 5/18) for work in or along Lake Michigan. The Army Corps regulates structures under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act. Evanston's lakefront is subject to significant erosion, particularly during periods of high lake levels. The city has participated in Army Corps shoreline protection studies and beach nourishment projects. Bluff properties must take care to avoid destabilizing slopes through construction, grading, or vegetation removal. Stormwater discharge to the lake is regulated under the city's NPDES municipal separate storm sewer system permit. Unauthorized modification of the Lake Michigan shoreline can result in state IDNR enforcement including restoration orders and fines. Federal Army Corps violations carry penalties up to $25,000 per day. The city may issue stop-work orders and building code violation fines of $75-$500 per day. Removal of shoreline vegetation without authorization may result in additional environmental penalties.
