Evanston's building code and public works standards require erosion and sediment control plans for construction projects involving soil disturbance. Contractors must install perimeter silt fencing, inlet protection for storm drains, and construction entrance stabilization before beginning earthwork. Disturbed areas must be stabilized within 14 days of final grading or if work is suspended for more than 14 days. Projects disturbing one acre or more require a National Pollutant Discharge Elimination System (NPDES) general construction permit from the Illinois EPA, including preparation of a Stormwater Pollution Prevention Plan (SWPPP). The SWPPP must identify potential pollutant sources, describe best management practices, and include an inspection schedule. The MWRD Watershed Management Ordinance also imposes soil erosion and sediment control requirements that apply within Evanston. Topsoil stockpiles must be protected from wind and water erosion. Dewatering operations must filter sediment before discharge. Street sweeping is required when construction vehicles track mud onto public roads. Failure to maintain erosion controls is a code violation subject to stop-work orders and fines of $75-$500 per day. Discharging sediment-laden water to the storm sewer or Lake Michigan is a violation of the Clean Water Act. Illinois EPA may impose fines for NPDES permit violations. The city may withhold inspections and certificates of occupancy until erosion control deficiencies are corrected.
