Cincinnati Zoning Code Section 1421-33 sets placement, height, and opacity standards for all fences and walls. In residential zoning districts, fences in any front yard, corner side yard, or corner rear yard may not exceed four feet in height and must not exceed 50 percent opacity, meaning the fence must be at least half see-through. In interior side yards and rear yards of residential districts, fences may reach a maximum height of six feet and may be 100 percent opaque, allowing solid privacy fencing. In non-residential districts such as commercial and industrial zones, front yard fences may reach six feet. Fence height is measured from the finished grade on the higher side of the fence to the top of the fence. Where a retaining wall and fence are combined, the total combined height is measured from the lower adjacent grade. Fences must be installed entirely within the property boundary and may not encroach on public rights-of-way, sidewalks, or utility easements. Corner lots have special visibility triangle requirements where fences within 25 feet of the intersection of two street right-of-way lines must comply with sight distance standards. All fences, regardless of size, require at minimum a Zoning Certificate of Compliance before construction begins.
