Under Cincinnati Zoning Code Section 1421-33, every fence or wall in the city requires some form of zoning approval before construction. Fences six feet tall or shorter require a Zoning Certificate of Compliance, or in historic overlay districts a Certificate of Appropriateness. For fences exceeding six feet in height, property owners must obtain a Zoning Variance from the Board of Zoning Appeals as well as a standard Building Permit. Applications are submitted to the Zoning Department at the Permit Center located at 805 Central Avenue, Suite 500, Cincinnati, Ohio 45202, or by email to ccpbpermitcenter@cincinnati-oh.gov. The application must include a site plan showing the proposed location, height, and opacity of the fence. Fences are classified as accessory structures under the zoning code and must comply with all setback and placement standards for the applicable zoning district. Properties located within historic conservation districts or local historic districts are subject to additional design review. Fences installed without proper zoning approval are subject to code enforcement action and potential removal orders.
