Cincinnati, OH Fence Regulations: Height Limits (2026)

Section 1421-33(b) sets two different height ceilings depending on where the fence sits on the lot. In any front yard, corner side yard, or corner rear yard, a fence, wall, or combination of the two 'may not exceed four feet in Residential Districts and six feet in all other districts and may not exceed an opacity of 50 percent', so a solid privacy screen isn't allowed facing the street even at four feet; it has to stay half-open. The rule carves out an exception for parking lot screening fences under § 1425-27, which follow separate standards. Move into an interior side yard or rear yard, and the ceiling rises to six feet with no opacity cap, meaning a fully solid six-foot privacy fence is allowed once it's set back from the street-facing yards.

Height itself is measured under § 1400-27-H(b) and (c): 'the height of other structures such as fences is the vertical distance from the ground level immediately under the structure to the top of a structure,' and a fence built on top of a retaining wall is measured from the top of the wall, not the base, so stacking a six-foot fence on a retaining wall can push the effective height well above six feet from grade.

Section 1421-33 also permits an entry gateway, trellis, or similar entry structure in the required front yard up to ten feet high and wide, subjects all fences to the driveway-visibility standards of § 1425-35, and allows above-ground pool deck railings in a rear yard up to eight feet, set back at least three feet from every property line. Electrical, barbed, and razor-wire fencing is an accessory conditional use only in Commercial, Manufacturing, and RF Districts, and is prohibited everywhere else in the city.
