Per Hernando County Code Section 10-55: all construction shall be of acceptable and durable materials customarily used or marketed for fencing; materials shall either be new or in new condition; the posts of each fence shall be resistant to decay, corrosion, or termite infestation; and all construction shall be installed with good workmanship. Front-yard fences (and rear-yard fences adjacent to waterfront, golf course, or common-area open space) must be chain link, split-rail, picket, or of similar construction such that at least 25% of the fence area is open and unobstructed when viewed at a right angle to the fence line. No fence or wall over 2 feet in height may block any driver's view within the clear-sight triangle of a driveway or street intersection. On corner lots, the secondary yard must maintain a 9-foot setback for fences over 4 feet that exceed 75% opacity. The 2024 amendment via Ord. 2024-07 (effective July 31, 2024) removed the Hernando County building-permit requirement for fences and walls under 7 feet, but the Section 10-55 design standards and Section 10-56 material prohibitions still apply regardless of whether a permit was required. The 8th Edition (2023) Florida Building Code Section 1609 (Wind Loads) applies to engineered fences and any taller wall (~140 mph Vult per ASCE 7-22). Pool barrier fences are reviewed separately under FBC Residential R4501.17 and FS Chapter 515. Sunshine 811 (1-800-432-4770) must be notified at least 2 business days before digging post holes per Florida Statute Chapter 556.
Fences using non-durable or non-customary materials (raw plywood, plastic tarps, etc.), posts that are not rot-resistant, or fences with poor workmanship may be cited under Section 10-55. Front-yard or open-space fences under 25% openness, fences over 2 feet inside a clear-sight triangle, and fences violating the 9-foot corner-lot setback are violations regardless of the permit-exempt status. Hitting a buried utility because Sunshine 811 was not called exposes the owner to liability under FS 556.105.
