Under Cupertino Municipal Code Section 16.28.040C, an 8-foot fence may be built in lieu of a permitted 6-foot fence only with a building permit and written approval from adjacent property owners. Separately, California Civil Code Section 841 presumes adjoining owners share reasonable boundary-fence costs equally, so neighbors should coordinate first.
Erecting an 8-foot fence without written neighbor consent violates Section 16.28.040 and is an infraction; boundary-fence cost disputes are handled civilly under state law.
