Quiet hours in Cupertino, CA — also called the noise ordinance, nighttime noise rules, or residential quiet time — define the hours during which excessive noise is prohibited.
Cupertino's Community Noise Control ordinance (CMC Chapter 10.48) defines nighttime and sets lower dBA limits during those hours. Nighttime on weekdays runs 8:00 p.m. to 7:00 a.m., and on weekends 6:00 p.m. to 9:00 a.m.
Under Cupertino Municipal Code Section 10.48.010, "nighttime" means weekday periods from 8:00 p.m. to midnight and midnight to 7:00 a.m., and weekend periods from 6:00 p.m. to midnight and midnight to 9:00 a.m.; "daytime" is 7:00 a.m. to 8:00 p.m. on weekdays and 9:00 a.m. to 6:00 p.m. on weekends. Section 10.48.040 caps noise crossing a property line at 50 dBA nighttime and 60 dBA daytime for residential-zoned origins, with the limit dropping at night. Section 10.48.060 separately bars any unreasonable "noise disturbance," defined as sound that annoys or disturbs a reasonable person of normal sensitivities. Enforcement is by the Noise Control Officer, and complaints can be filed through Cupertino 311.
A violation of Chapter 10.48 is a misdemeanor punishable as provided in CMC Chapter 1.12 (CMC 10.48.070). Code Enforcement typically issues a courtesy notice first, then a citation for repeat verified violations at the same location.
