Cupertino has adopted an EV reach-code ordinance and CALGreen standards requiring EV-ready and EV-capable parking spaces in new development, plus an expedited permitting process for installing residential and commercial charging stations.
Cupertino adopted EV reach-code Ordinance 19-2193, layered on the California Green Building Standards Code (CALGreen), which requires new residential and nonresidential projects to provide a percentage of EV-ready, EV-capable and EV-installed parking spaces. The city offers an Expedited Permitting Process for Electric Vehicle Charging Stations (EVCS), with most qualifying permits issued within 3 to 5 business days and no Planning Division review unless the Building Official finds a specific adverse impact. Accessible EVCS spaces must meet minimum dimensions, such as a van-accessible space at least 144 by 216 inches. The city does not treat on-street public charging as a parking-code matter; California Vehicle Code Section 22511 governs enforcement of marked EV charging stalls.
New construction that fails to provide required EV-ready or EV-capable spaces will not pass CALGreen plan check. Parking a non-charging vehicle in a marked EV charging space is enforceable under California Vehicle Code Section 22511.
