Neb. Rev. Stat. Β§34-101 et seq. (the Nebraska partition fence law) applies to agricultural and rural properties and governs shared boundaries. Under this law, adjoining landowners share equal responsibility for maintaining the fence on their common property line. A landowner who builds a partition fence may seek contribution from the adjoining owner for half the cost. Nebraska has no spite fence statute. For residential subdivisions within unincorporated Douglas County, HOA rules or deed covenants may govern fence disputes.
Failure to maintain the portion of a partition fence you are responsible for may result in the adjoining owner taking action under Β§34-101 and recovering costs.
