There is no unincorporated Kane County ordinance dividing the cost of a boundary fence between neighbors. This is governed by the statewide Illinois Fence Act (765 ILCS 130). Section 3 requires that where two or more persons have adjoining lands, each makes and maintains a just proportion of the division fence. Section 4 applies in counties under 1,000,000 population (which includes Kane) outside municipal limits, obligating an adjoining owner to build or pay for a just proportion. If neighbors dispute the share, the matter may be settled by two township or precinct fence viewers. The county's fence permit rules still govern placement, easements, and floodway restrictions.
Fence-cost disputes are a civil matter under the Fence Act; fence viewers can apportion the obligation, and a neighbor who refuses may be liable for the other's proportionate cost.
