Backyard composting is legal in Kane County. Code Chapter 15 defines composting as a managed aerobic process, and yard waste is a defined material — but a compost pile that becomes odorous, rodent-harboring, or a nuisance can be cited under the county nuisance ordinance.
Kane County Code 15-1 defines "Composting" as "An aboveground microbial process that converts organic waste to soil or mulch by decomposition of material through an aerobic process that requires adequate oxygen and moisture," and "Compost" as the humus-like product. Residential composting of yard waste and food scraps is permitted. The limit is nuisance-based: a pile that emits offensive odors, harbors rodents/vermin, or includes prohibited materials (garbage accessible to animals, refuse) can be declared a nuisance under 15-2 and ordered abated. Keep piles aerated, contained, and free of meat/dairy to avoid pests. Illinois bans landscape waste from landfills, encouraging on-site composting.
A compost operation that becomes a nuisance (odor, vermin harborage, animal-accessible garbage) is citable under 15-2; fine up to $500/day (15-6); county may abate and bill the owner (15-7).
