Montgomery County requires a development permit for fences within or within 100 feet of the 100-year floodplain. Outside floodplain areas, no county permit is required for fences on private property. New floodplain regulations took effect October 1, 2025.
In unincorporated Montgomery County, no permit is required for most residential fences outside the floodplain. However, a development permit from the Environmental Health / Permitting office is required for any fence located within the 100-year floodplain or within 100 feet of the floodplain/floodway boundary. New floodplain regulations effective October 1, 2025 apply to all development in the floodplain. A new fee schedule took effect June 2, 2025. Permit applications are submitted to the Montgomery County Environmental Health office.
