It states that beyond the front-yard area a fence may be built up to seven feet in height "without the need for a building permit," and that fences constructed over seven feet "may be allowed, but require a building permit and engineering." This mirrors the statewide California Building Code permit exemption, under which fences not over seven feet high (measured from adjacent grade on the side that yields the greatest height, and not supporting a surcharge) are exempt from a building permit. A permit exemption is not a waiver of the zoning rules: a permit-exempt fence must still comply with the Title 21 height-by-yard limits (eight feet side/rear, three feet front and corner-side yard) and with vision-clearance requirements. Masonry or concrete fence walls, taller fences, and walls supporting a surcharge generally require structural review. Because the ultimate (planned) property line, zoning district, and corner-lot status all affect what you can build, the County advises confirming requirements with the Planning Department at (209) 525-6330 and Building Services at (209) 525-6557 before construction.
Installing a fence over seven feet without the required building permit, or building any fence that violates the Title 21 yard height limits, can result in a stop-work order, a code enforcement case, and an order to obtain a permit or remove the structure.
