Under Public Safety Article 12-503, Maryland mandates the Maryland Building Performance Standards (MBPS), incorporating the International Residential Code Appendix G and the International Swimming Pool and Spa Code. Every pool or spa deeper than 24 inches requires a barrier at least 48 inches high measured from the outside. Gates must open outward, self-close, and self-latch with the latch at least 54 inches above grade. Openings cannot exceed 4 inches. The MBPS applies in all 24 jurisdictions; local governments may adopt stricter standards but cannot weaken the state baseline. Inspection is performed by local code officials.
Failure to provide compliant barriers may result in stop-work orders, denial of certificate of occupancy, and civil fines under local building codes; civil liability for drowning incidents.
