Under MCA 50-60-203, the Department of Labor and Industry adopts the state building code, including pool barrier provisions from the International Swimming Pool and Spa Code (ISPSC). Residential pools deeper than 24 inches must have a barrier at least 48 inches high measured from the outside. Gate latches must be at least 54 inches from the ground or otherwise child-resistant. Openings in the barrier cannot allow passage of a 4-inch sphere. Cities and counties enforce through their building inspection programs but cannot adopt less stringent requirements. Hot tubs with locked covers meeting ASTM F1346 may substitute for full barriers.
