Kentucky adopts the 2018 International Residential Code through 815 KAR 7:125 (Kentucky Residential Code, 2nd Edition). Appendix G of the KRC, titled 'SWIMMING POOLS, SPAS AND HOT TUBS,' governs barriers around residential pools. AG105.2 (Outdoor swimming pool) requires: '1. The top of the barrier shall be at least 48 inches (1219 mm) above grade measured on the side of the barrier which faces away from the swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be 4 inches (102 mm) measured on the side of the barrier which faces away from the swimming pool. 2. Openings in the barrier shall not allow the passage of a 4-inch-diameter (102 mm) sphere. 3. Solid barriers which do not have openings, such as a masonry or stone wall, shall not contain indentations or protrusions, except for normal construction tolerances and tooled masonry joints.' For horizontal/vertical fences with horizontal members less than 24 inches apart, the horizontal members must be on the pool side and vertical spacing must not exceed 1-3/4 inches (AG105.2 item 4). Maximum mesh size for chain-link fences is 2-1/4 inches square unless slats reduce openings to 1-3/4 inches (item 6). Access gates per AG105.2 item 8 must comply with items 1 through 7, be equipped with a locking device, open outward away from the pool, and be self-closing and self-latching. If the release mechanism is less than 54 inches from the bottom of the gate, it must be located on the pool side at least 3 inches below the top of the gate, and the gate and barrier must have no opening larger than 1/2 inch within 18 inches of the release mechanism. Where a wall of the dwelling serves as part of the barrier (AG105.2 item 9), the pool must be equipped with a powered safety cover in compliance with ASTM F 1346, doors with direct access must have an alarm meeting UL 2017, or other approved means of protection must be provided. The Warren County/Joint Zoning Ordinance Sec. 4.4.5.E.6.c provides the local backstop: 'The swimming pool area shall be enclosed by a fence or other suitable barrier with a minimum height of not less than 4 feet. Openings in the fence shall be small enough to prevent a child from entering the enclosure other than through the gate.'
A pool installed without a compliant barrier violates Appendix G of the KRC and Sec. 4.4.5.E.6.c of the zoning ordinance. The Bowling Green Building Division can issue stop-use orders, require the pool to be drained until a compliant barrier is installed, and assess civil penalties. Failure to maintain self-closing/self-latching gates is a common violation cited during pool inspections.
