California Residential Code §R326 and Health & Safety Code §115920-115929 (the Pool Safety Act) - adopted by Sacramento County in SCC Title 16 - require an enclosing barrier at least 60 inches in height for any new or remodeled pool. The barrier's exterior face cannot have hand- or footholds (chain link must be 11-gauge or smaller). Gates must open AWAY from the pool, be self-closing and self-latching, with the latch at least 60 inches above grade. Gaps cannot allow a 4-inch sphere to pass. Additionally, building permit issuance requires at least TWO of the seven CA Pool Safety Act features: enclosing barrier; removable mesh fencing; safety pool cover; exit alarm on doors leading to pool; self-closing/self-latching device on doors; pool alarm; or other approved means.
Building permit cannot be finaled until barrier is verified compliant. Non-compliant barriers on existing pools: code enforcement order with $100/$200/$500 administrative escalation. Drowning death from non-compliant barrier: civil liability under CA H&SC §115928 plus negligence per se.
