Chico enforces the California Swimming Pool Safety Act (HSC §115920–115929, amended by SB 442). New or remodeled pools/spas at single-family homes must install at least two of seven drowning-prevention safety features, including a 60-inch enclosure meeting Cal. Building Code Appendix AX.
Chico does not impose a separate pool-fence ordinance; the state Swimming Pool Safety Act (Health & Safety Code §115920 et seq., as amended by SB 442, effective Jan 1, 2018) governs. When a building permit is issued for a new pool/spa or for the remodel of an existing pool/spa at a private single-family home, the property must include at least two of seven approved drowning-prevention safety features. These include: (1) an isolation enclosure at least 60 inches tall meeting §115923; (2) removable mesh fencing per ASTM F2286 with a self-closing, self-latching, key-lockable gate; (3) an approved safety pool cover meeting ASTM F1346; (4) exit alarms on doors providing direct access; (5) self-closing/self-latching devices on doors with a release at least 54 inches above the floor; (6) alarms on the pool surface; (7) other approved barriers meeting equivalent standards. Enclosure gaps must not pass a 4-inch sphere and the surface must be free of climbable footholds. Chico Building Division verifies compliance at final inspection under California Building Code Title 24 Part 2.5 Appendix AX.
Failure to install required safety features results in failed building inspection and inability to obtain a Certificate of Occupancy or final approval. Property owners face civil liability under HSC §115929 and personal injury exposure for non-compliant pools.
