The barrier must have no openings larger than 4 inches, no horizontal members inside the fence that could serve as climbing aids within 45 inches of the ground, and must extend within 2 inches of the ground. If the house wall forms part of the barrier, all doors opening to the pool must have alarms or the pool must have a power safety cover. Above-ground pools with walls at least 60 inches tall and removable ladders satisfy the barrier if the ladder is secured or removed when unattended. Final inspection through Pikes Peak Regional Building Department is required before filling.
Operating a pool without compliant barriers is a 500-dollar fine and mandatory drainage order until compliance. Child drowning incidents at non-compliant pools create severe civil liability and possible criminal negligence charges.
