Under Cal. Health and Safety Code section 115922, when a building permit is issued for the construction of a new pool or spa, or for the remodel of an existing pool or spa, at a private single-family home, the property owner must install at least two of seven specified drowning-prevention safety features. These include: (1) an enclosure meeting HSC 115923 requirements that isolates the pool from the home; (2) removable mesh fencing meeting ASTM F2286 with a self-closing self-latching gate; (3) an ASTM F1346-23 safety pool cover; (4) exit alarms on pool-access doors/windows; (5) a self-closing, self-latching device on pool-access doors with the release at least 54 inches above the floor; (6) an ASTM F2208 water-entry alarm; or (7) other independently verified equivalent protection. An exit alarm paired with a door latch on the same or separate doors does NOT count as two features. The HSC 115923 enclosure standard requires a barrier at least 60 inches (5 feet) tall, openings no greater than 4 inches wide, no climbable surfaces, and a self-closing, self-latching gate that opens outward away from the pool. Daly City enforces these requirements through Title 12 of the Municipal Code (which adopts the California Building Code) at building-permit final inspection.
Failing to install the required two safety features is grounds to deny final building-permit signoff, blocking lawful pool use. Operating a non-compliant pool can also expose the owner to civil liability under California premises-liability law if a child drowns.
