All residential pools, spas, and hot tubs deeper than 24 inches require a 48-inch minimum barrier with self-closing, self-latching gates. Above-ground pools with lockable ladders can use the pool wall as barrier. Building permit required from town building department for all pool installations. Suffolk County Health Services regulates public and semi-public pools under Article 6 of the NY Sanitary Code and Suffolk County Sanitary Code.
Building code violations up to $1,500 per day. Pool cannot be filled until inspection passes. Drownings in noncompliant pools can trigger civil liability.
