Pool-barrier fencing is governed by the New York State Uniform Fire Prevention and Building Code (Residential Code of New York State, Appendix G, which adopts the ISPSC barrier provisions) together with the Town of Islip Town Code. The Town of Islip Division of Building Zoning FAQ states that pools require barriers subject to the NYS Residential Code and Town of Islip Town Code, and directs owners to consult with a Building Plans Examiner and the Zoning Department. The New York State barrier standard generally requires the enclosure to be at least 48 inches high with no openings allowing passage of a 4-inch sphere, and self-closing, self-latching gates that open away from the pool. These pool-barrier requirements are in addition to the general fence height, setback and material rules of Islip Town Code Article XXX.
An unfenced or non-compliant pool barrier is a violation of the New York State Residential Code and the Town Code, enforced by the Division of Building. The Town may issue an order to remedy, withhold or revoke a certificate of occupancy/compliance, and impose penalties; a pool may not be filled or used until a conforming barrier is in place.
