Small backyard recreational fires are permitted in the Town of Islip under New York's 6 NYCRR Part 215, but residential brush burning is prohibited statewide each spring. From March 16 through May 14, NYSDEC bans residential brush fires because open debris burning is the single largest cause of spring wildfires in the state. Backyard fire pits and small cooking fires using clean, untreated wood remain allowed year-round if kept small and attended.
New York's open-fire rule allows on-site burning of downed limbs and branches under 6 inches in diameter and 8 feet in length only in towns with a total population under 20,000, and only between May 15 and the following March 15 - never during the spring fire season. The NYSDEC's statewide residential brush-burning prohibition runs 'March 16 through May 14' each year, and the agency states that open burning of debris is 'the single-largest cause of spring wildfires in New York State.' Even during the ban, NYSDEC confirms that 'backyard fire pits and campfires under 3 feet in height and 4 feet in length, width, or diameter' and 'small cooking fires' using 'only charcoal or dry, clean, untreated or unpainted wood' remain allowed, provided they are not left unattended and are fully extinguished. The Town of Islip enforces these state rules through its Division of Fire Prevention, and the Chief Fire Marshal may prohibit all outdoor fires when conditions make them hazardous. Burning leaves and garbage is prohibited year-round.
Conducting a residential brush fire during the March 16-May 14 ban, or burning prohibited materials, violates 6 NYCRR Part 215 and is subject to NYSDEC penalties; the Islip Division of Fire Prevention may order any hazardous fire extinguished and issue Chapter 19 fire-code violations.
