The Town of Islip's Chapter 19 (Fire Prevention), Article IV adds a local prohibition: open burning of grass, brush, leaves, rubbish, building materials and other combustible or flammable materials is prohibited within the Town unless a permit for such open burning has first been obtained from the state or local air and water quality management authority, and that permit must be present at the burn site and available for inspection by the Fire Department, Police Department or Division of Fire Prevention. The Chief Fire Marshal may prohibit all such fires anywhere in the Town when atmospheric conditions or local circumstances make them hazardous.
Unlawful open burning violates 6 NYCRR Part 215 (NYSDEC enforcement and penalties) and Islip Chapter 19; the Division of Fire Prevention may order the fire extinguished, and fire-code violations carry fines starting at not less than $1,000 for a first offense.
