Islip, NY Fire Regulations: Outdoor Burning (2026)

Under New York's open-burning regulation, 6 NYCRR Section 215.2, 'except as allowed by section 215.3 of this Part, no person shall burn, cause, suffer, allow or permit the burning of any materials in an open fire.' The NYSDEC notes that burning refuse, trash, tires and other solid wastes (including in burn barrels) is prohibited and that only 'charcoal or dry, clean, untreated, and unpainted wood' may be burned in permitted fires. The Town of Islip's Chapter 19 (Fire Prevention), Article IV adds a local prohibition: open burning of grass, brush, leaves, rubbish, building materials and other combustible or flammable materials is prohibited within the Town unless a permit for such open burning has first been obtained from the state or local air and water quality management authority, and that permit must be present at the burn site and available for inspection by the Fire Department, Police Department or Division of Fire Prevention. The Chief Fire Marshal may prohibit all such fires anywhere in the Town when atmospheric conditions or local circumstances make them hazardous.
