Huntington, NY Fire Regulations: Outdoor Burning (2026)

Huntington Code § 111-96 makes it "unlawful and a violation of this Chapter to burn rubbish, pesticides, plastics, or other non-organic materials," full stop, no size exception. Section 111-97(A) then sets the general size cap for any other open burning: a pile larger than three feet in diameter and two feet in height is unlawful anywhere in the Town. Two narrow exemptions exist under § 111-97(B): organic agricultural waste burned on contiguous farmland larger than five acres, on-site where grown, fully consumed within 24 hours, with extinguishing equipment on hand and the local fire company notified before ignition; and live-fire training conducted by an organized fire company or district following New York State Office of Fire Prevention and Control guidelines.

Neither exemption covers a resident burning yard debris, construction scrap or household trash in a backyard pit; that conduct falls under the general size cap and the flat rubbish-burning ban. Fire code officials and local fire departments enforce these limits, and because the standard applies townwide, it reaches unincorporated Huntington neighborhoods outside the separately-governed Villages of Huntington Bay, Lloyd Harbor, Northport and Asharoken.
