Consumer fireworks are illegal everywhere in the Town of Islip. New York Penal Law Section 270.00 makes possessing or using any fireworks a violation and selling them a misdemeanor. While a state amendment lets a county opt in to legalize ground-based 'sparkling devices' (fountains and sparklers), Suffolk County has NOT opted in, so even sparklers remain illegal in Islip. Only state-licensed professional displays are permitted.
New York Penal Law Section 270.00 ('Unlawfully dealing with fireworks and dangerous fireworks') provides that 'any person who shall possess, use, explode or cause to explode any fireworks or dangerous fireworks is guilty of a violation,' and that 'any person who shall offer or expose for sale, sell or furnish, any fireworks or dangerous fireworks is guilty of a class B misdemeanor.' A 2014 amendment carved 'sparkling devices' out of the fireworks definition, but under Penal Law Section 405.00 their sale and use are legal only in a county or city that affirmatively authorizes them. The New York State Division of Homeland Security and Emergency Services lists Suffolk County among the jurisdictions that prohibit sparkling devices, stating that 'sale and use of Sparkling Devices is legal in counties and cities that have NOT enacted a local law pursuant to section 405.00 of the Penal Law of NY.' Because the Town of Islip lies within Suffolk County, sparklers, fountains and all other consumer fireworks are illegal there. The Islip Division of Fire Prevention issues permits only for professional fireworks displays.
Possessing or using fireworks is a Penal Law 270.00 violation (fine and/or up to 15 days in jail); offering or selling fireworks is a class B misdemeanor, escalating to a class A misdemeanor for sales of $500 or more or to a minor. Suffolk County and local police seize illegal fireworks.
