Permit rules are stated in the Town of Islip Division of Building Zoning FAQ and in Section 68-406 of the Town Code. The Town's official FAQ states that a permit is not required to install a fence, provided that the fence complies with Town of Islip regulations, including but not limited to zoning and traffic safety. Walls are treated differently: Section 68-406F requires that all walls greater than 18 inches in height from average, undisturbed grade obtain a permit prior to construction and be set back from any property line a minimum of 4 feet or a distance equal to the height of the wall, whichever is greater; for marine bulkheads a Town of Islip Wetlands and Watercourses Permit may serve as the required permit. Section 68-406G provides that walls 18 inches or less in height do not require a setback or permit unless directed by the Town Engineer. All walls must receive a determination of the necessity of site plan review from the Divisions of Building and Engineering prior to construction.
Building a wall over 18 inches without the required permit, or a fence that violates zoning or traffic-safety provisions, is enforced by the Division of Building. The Town may issue a stop-work order, require a permit application after the fact, and impose the penalties provided in Chapter 68 of the Town Code.
