Full Breakdown
In the Town of Babylon's unincorporated hamlets, West Babylon, North Babylon, Deer Park, Wyandanch, Copiague and others, a fence built to the height and placement standards set for its residential district (Article VII, A Residence District) is exempt from a building permit. Homeowners who need a taller or differently placed fence must obtain a variance from the Zoning Board of Appeals or a modification from the Planning Board; once granted, that fence does require a building permit before construction. The same compliant-fence exemption and variance-triggers-permit structure repeats district by district throughout Chapter 213, including the AA Residence District at § 213-75.14.
Violations & Fines
Installing a noncompliant fence without the required variance or building permit is a Ch. 213 zoning violation: a $250-$1,000 fine and up to 15 days' imprisonment for a first offense, with each day a separate violation (§ 213-8).
