El Monte enforces pool barrier standards from California Building Code § 3109 and the California Swimming Pool Safety Act (Health & Safety Code §§ 115920-115929), adopted via EMMC Title 15. Barriers must be a minimum of 60 inches above grade measured from the side facing away from the pool. Maximum vertical clearance from grade to the bottom of the barrier is 2 inches. Vertical member spacing cannot exceed 1-3/4 inches. Where horizontal members are less than 45 inches apart, they must be on the pool side. Pedestrian access gates must open outward away from the pool, be self-closing, and have a self-latching device with the release mechanism at least 54 inches above the ground. Removable mesh pool fencing meeting ASTM F2286 is permitted as an alternative. Under HSC § 115922, new pools and pools undergoing permitted remodel must satisfy at least two of seven approved safety features (enclosure, removable mesh, safety cover, exit alarms, self-closing doors, pool alarms, or equivalent).
Building inspections fail if barriers are deficient — pool cannot receive final approval/water until corrected. Operating a pool without a compliant barrier is a public nuisance subject to abatement. Civil liability under HSC § 115928 may attach if a drowning occurs in a non-compliant pool. EMMC Chapter 1.20 general penalties ($100/$200/$500) apply for code-enforcement actions.
