Residential swimming pool barriers in Pinellas County are governed by the Florida Residential Swimming Pool Safety Act (Fla. Stat. Chapter 515) and the Florida Building Code as adopted in Chapter 22 of the county code. Section 515.29 requires every new residential pool, spa, or hot tub to incorporate at least one approved safety feature, including a barrier at least four feet high on the outside, an approved safety pool cover, exit alarms on all doors and windows providing direct pool access, self-closing and self-latching devices on those doors, or a pool alarm. Gates in pool barriers must open outward, be self-closing, and have self-latching hardware with releases located out of reach of small children. Pinellas County BDRS inspects pools before issuing certificates of completion.
Failure to equip a new residential pool with at least one Chapter 515 safety feature is a second-degree misdemeanor under Fla. Stat. 515.29 punishable by fines and jail time, with a 45-day correction window and required drowning-prevention education to avoid penalties.
